The price excludes the cost of delivery charges by POS LAJU or any other logistics Services , any applicable goods and services tax, value added tax or similar tax which the Buyer shall be liable to pay to NUSAR in addition to the price.

TERMS OF PAYMENT

The Buyer shall be entitled to make payment for the Goods pursuant to the various payment methods set out in NUSAR’s website. The terms and conditions applicable to each type of payment, as contained in NUSAR’s website, shall be applicable to the Contract.

In addition to any additional terms contained in NUSAR’s website, the following terms shall also apply to the following types of payment:

Cash Payment

Payment can be made by cash via Maybank (Cash Depository Machine or Over the Counter) to NUSAR SPORTS APPAREL PLT bank account. Balance change, if any, shall be provided to customers together with the delivery of purchase.

Credit Card

Credit Card payment option is available for all Buyers. NUSAR SPORTS APPAREL PLT accepts all Visa and MasterCards, both Credit and Debit, and is 3D Secure (Verified by Visa, and MasterCard Secure) enabled. RISK AND PROPERTY OF GOODS

Risk of damage to or loss of the Goods shall pass to the Buyer at the time of delivery or if the Buyer wrongfully fails to take delivery of the Goods, the time when NUSAR has tendered delivery of the Goods.

Notwithstanding delivery and the passing of risk in the Goods or any other provision of these Conditions the property in the Goods shall not pass to the Buyer until NUSAR SPORTS APPAREL PLT has received in cleared funds payment in full of the price of the Goods and all other goods agreed to be sold by NUSAR SPORTS APPAREL PLT to the Buyer for which payment is then due.

CONTRACT

An acknowledgement e-mail confirming receipt of your order will be sent to your e-mail address provided after an order has been placed. This e-mail is only an acknowledgement and will not constitute acceptance of your order.

A contract between NUSAR SPORTS APPAREL PLT for the purchase of the goods will not be formed until the buyers full payment has been approved and NUSAR SPORTS APPAREL PLT have debited your credit or debit card, received your online bank transfer or proof of cash payment to our bank account. PAYMENT

We accept credit cards/debit cards online payment, bank transfers and cash deposits to our account. (see payment Clause above)

Please take note that every shopper has a grace period of 24 hours (1 day) upon placing an order to make payment for the items confirmed and accepted by NUSAR SPORTS APPAREL PLT

An invoice would be generated to purchasers once the payment is approved or obtained.

Payments that are unfulfilled within the stipulated grace period will result in the process void and said item(s) will be made available on the website again, and customers will be notified accordingly.

DELIVERY

Fulfilled orders will be shipped out as in the Delivery Policy. All packages will be sent via PosLaju courier service. or any other chosen Logistics services.

Please note that PosLaju operates and make deliveries from Monday – Saturday (except for the first Saturday of every month & public holidays).

Customers will receive an e-mail notification once the fulfilled order has been dispatched. Item can be tracked via courier company website. Please allow 24 hours from receipt of e-mail notification before tracking the package. NUSAR SPORTS APPAREL PLT will not be held responsible for any lost package or damaged goods en-route delivery by courier companies.

TYPOGRAPHICAL ERRORS

In the event a product is not published correctly due to typographical error or systems error:

NUSAR SPORTS APPAREL PLT shall not be liable to the Buyer or be deemed to be in breach of the Contract by reason of any delay in performing or any failure to perform any of NUSAR SPORTS APPAREL PLT obligations if the delay or failure was due to any cause beyond NUSAR SPORTS APPAREL PLT’s reasonable control. Without prejudice to the generality of the foregoing the following shall be regarded as causes beyond NUSAR SPORTS APPAREL PLT reasonable control:

→ Act of God, explosion, flood, tempest, fire or accident;
→ War or threat of war, sabotage, insurrection, civil disturbance or requisition;
→ Acts of restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental parliamentary or local authority;
→ Import or export regulations or embargoes;
→ Interruption of traffic, strikes, lock-outs, other industrial actions or trade disputes (whether involving employees of NUSAR or of a third party);
→ Interruption of production or operation, difficulties in obtaining raw materials labor fuel parts or machinery
